    JOYARTI TERMS OF SERVICE

    Welcome to Joyarti. These Terms of Service (“Terms”) govern your access to and use of Joyarti’s website, applications, and services, including uploading photos or other content, generating stylized artworks or 3D models, and purchasing customized products (collectively, the “Services”).
    By accessing or using the Services, creating an account, uploading content, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the services.

    1. Eligibility

    You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using Joyarti, you represent and warrant that you meet this requirement.

    2. Account Registration and Security

    You may need to create an account to use certain parts of the services. You agree to:
    • Provide accurate, current, and complete information;
    • Maintain and promptly update your information;
    • Keep your login credentials secure and confidential; and
    • Accept responsibility for all activities that occur under your account.
    We may suspend or terminate your account if we believe you have violated these Terms or applicable law.

    3. User Content

    3.1 Definition

    “User Content” means any photos, images, text, or other materials that you upload, submit, or otherwise provide to Joyarti.

    3.2 Ownership

    You retain ownership of your User Content to the extent you own it. Joyarti does not claim ownership of your User Content.

    3.3 Your Representations and Warranties

    By uploading or submitting User Content, you represent and warrant that:
    1. You own or have obtained all necessary rights, permissions, and licenses to use and submit the User Content to Joyarti;
    2. The User Content does not infringe or violate any third-party rights, including copyright, trademark, trade dress, privacy, publicity, moral rights, or any other proprietary rights;
    3. If the User Content contains images of any individuals, you have obtained all necessary permissions from those individuals (or their guardians if minors) to use their likenesses;
    4. Your User Content complies with these Terms and all applicable laws.

    4. Prohibited Content and Conduct

    Joyarti is intended for transforming real-life photos into original artistic styles. You may not upload, submit, or request content that:
    • Includes copyrighted or trademarked characters or brands (e.g., Disney, Marvel, Pixar, Nintendo, Pokémon, Sanrio, anime/film/game characters, etc.);
    • Depicts or uses celebrity, athlete, or public-figure likenesses without express rights;
    • Contains sports team / league logos or branding (NBA, NFL, FIFA, etc.) without rights;
    • Uses screenshots from movies, TV shows, games, comics, or other protected media;
    • Includes any brand logo, packaging, or product marks you do not own;
    • Is unlawful, threatening, hateful, defamatory, obscene, or otherwise harmful;
    • Violates any applicable law or regulation.
    We may remove User Content, refuse generation, cancel orders, or suspend accounts if we reasonably believe content violates this section.

    5. License You Grant to Joyarti

    To operate and provide the Services, you grant Joyarti a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:
    • host, store, reproduce, and display your User Content;
    • modify your User Content solely to generate stylized or 3D outputs, previews, and to fulfill your orders; and
    • create derivative works from your User Content only as necessary for the Services.
    This license is limited to operating, improving, and fulfilling the Services and does not give Joyarti the right to commercially exploit your User Content outside that purpose without your consent.

    6. AI / Stylization Disclaimer

    Joyarti uses automated systems, including AI models, to generate stylized artworks or 3D models based on User Content. You acknowledge and agree that:
    • Outputs are algorithmically generated and may have unexpected variations;
    • On-screen previews are approximations of final physical products;
    • Joyarti does not guarantee outputs will meet subjective expectations;
    • Joyarti may refuse to generate outputs that appear to involve prohibited or infringing content.

    7. Orders, Pricing, and Payments

    7.1 Custom Product Nature

    Joyarti products are customized based on your User Content. Once production begins, orders may not be cancelable.

    7.2 Pricing and Taxes

    Prices are displayed at checkout. You are responsible for any applicable taxes, duties, or customs fees unless otherwise stated.

    7.3 Payment

    By providing a payment method, you authorize Joyarti (or our payment processors) to charge the total amount of your order, including shipping and taxes.

    8. Shipping, Returns, and Refunds

    Shipping timelines, return eligibility, and refund rules are described in our Shipping & Delivery page, which is incorporated into these Terms by reference.
    In summary:
    • Refunds or replacements may be offered for defective/damaged items or Joyarti production errors.
    • Refunds are not offered for subjective dissatisfaction with style, user error, or prohibited/infringing uploads.

    9. Joyarti Intellectual Property

    All content and materials provided by Joyarti, including our website, software, AI models, workflows, style libraries, designs, templates, and branding (collectively, “Joyarti IP”) are owned by Joyarti and protected by law.
    You may not:
    • copy, modify, distribute, sell, or lease any part of Joyarti IP;
    • reverse-engineer or attempt to extract source code or model weights;
    • use Joyarti IP to build or assist a competing service.

    10. DMCA Copyright Policy

    Joyarti respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

    10.1 Notice of Alleged Infringement

    If you believe content on Joyarti infringes your copyright, please send a DMCA notice containing:
    1. Your physical or electronic signature;
    2. Identification of the copyrighted work claimed to be infringed;
    3. Identification of the allegedly infringing material (including URL or order details);
    4. Your contact information (address, phone, email);
    5. A statement of good-faith belief that use is unauthorized;
    6. A statement under penalty of perjury that the information is accurate.

    10.2 Counter-Notice

    If you believe your content was removed by mistake, you may submit a counter-notice including:
    1. Your signature;
    2. Identification of removed content;
    3. A statement under penalty of perjury that removal was a mistake;
    4. Your consent to jurisdiction in your legal district;
    5. Your contact information.
    We may restore content unless the rights holder files legal action.

    10.3 Repeat Infringers

    We may terminate accounts of users who are repeat infringers.

    11. Trademark Policy

    You may not upload or request products involving trademarks or logos you do not own or have permission to use. We may cancel orders suspected of trademark infringement.

    12. Privacy

    Your use of Joyarti is subject to our Privacy Policy, which explains how we collect, use, retain, and share data, including User Content.

    13. Termination

    Joyarti may suspend or terminate your access to the Services at any time if we reasonably believe:
    • you violated these Terms,
    • your User Content is prohibited or infringing, or
    • Your use may expose Joyarti to legal risk.
    You may stop using the services at any time.

    14. Disclaimer of Warranties

    The Services are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, Joyarti disclaims all warranties, express or implied, including:
    • merchantability,
    • fitness for a particular purpose,
    • non-infringement,
    • accuracy or reliability of AI-generated outputs.

    15. Limitation of Liability

    To the maximum extent permitted by law:
    • Joyarti will not be liable for indirect, incidental, consequential, special, or punitive damages;
    • Joyarti is not liable for user infringement of third-party rights;
    • Joyarti’s total liability for any claim will not exceed the amount you paid for the specific order giving rise to the claim.
    Some jurisdictions do not allow certain liability exclusions, so these limits may not apply to you in full.

    16. Indemnification

    You agree to defend, indemnify, and hold harmless Joyarti and its affiliates, officers, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of:
    • your User Content or its use in the Services;
    • your violation of these Terms;
    • your infringement or violation of any third-party rights.

    17. Governing Law and Disputes

    These Terms are governed by the laws of USA, without regard to conflict-of-law rules.
    You agree that any dispute will be brought exclusively to the courts located in USA, unless arbitration is required by applicable law.

    18. Changes to These Terms

    We may update these Terms from time to time. We will post updated terms with a new effective date. Continued use of the Services after changes become effective means you accept the updated Terms.
